Is Marijuana Legal in Ohio?
Medical marijuana has been legal in the state of Ohio since 2016 and there is current movement on legislation for legalizing recreational use, which was still illegal at the end of 2021. Ohio was the sixth state to decriminalize cannabis back in 1975, making first time offenders found possessing up to 3.5 ounces receive a misdemeanor and $150 fine. While Ohio has been one of the most lenient states on cannabis in the U.S., it is still not legal to grow or buy marijuana for recreational use. Medical users must purchase their marijuana products from a dispensary and currently cannot grow their own medical garden, although new legislation could soon change that.
As recently as October 2021, Democrats and Republicans have both put bills before the state legislature proposing legalized recreational use. A bill which would allow anyone 21 years of age and older to possess marijuana and to grow cannabis recreationally has been presented to Ohio’s lawmakers, by both sides of the aisle with Democrat and GOP bills up for review. At the very least, it looks promising for voters to have their chance to legalize the drug on the November 2022 ballot if legislators cannot get it done before that.
Most legislators in Ohio, regardless of political views, feel that legalized marijuana in Ohio is something whose time has come and that adults should be able to make this decision for themselves. We hope that soon Ohio residents of Columbus, Cleveland, Cincinnati, Dayton, Akron, or Toledo are all able to grow their own marijuana garden at their discretion with quality cannabis seeds.
