Despite a large public opinion for the legalization of cannabis in some form as well as decriminalization, many constituents feel that Idaho’s politicians are out of step with supporting their beliefs. In fact, lawmakers in Idaho approved a law that would have made voter-initiated ballot measures extremely difficult and unlikely to qualify. Idaho’s Gov. Brad Little signed the law, which would have required petitioners to obtain signatures from at least 6% of registered voters in every single one of Idaho’s 35 legislative districts.
The Idaho state Supreme Court overturned this restrictive ballot initiative earlier in 2022, reinstating the previous requirements for petitioners to obtain signatures from 6% of voters in 18 districts instead of all 35. While this move opened the door for proponents to organize a petition to include at the ballots, this initiative had to be submitted by May 1st to be included in the November 2022 election and failed to submit the required number of signatures in time to qualify.
Cannabis Penalties in Idaho
Idaho laws and penalties on cannabis allow charging an individual for possession with a sentence of up to one year in jail and/or a $1,000 fine for having up to 1 ounce of marijuana. These draconian laws punish minorities the hardest, with a report by the ACLU showing that black citizens in Idaho are nearly 4 times more likely to be arrested than their white neighbors for cannabis possession.
Medical Marijuana in Idaho
Several attempts to reform the policy on medical cannabis in Idaho have failed getting past the legislative process, with ballot initiatives falling short of required signatures in 2012 and 2014. Initiatives attempted in 2016 and 2018 were withdrawn for various reasons, and the ballot initiative in 2020 was suspended due to the COVID-19 pandemic. In 2015, Idaho Legislature passed a bill to legalize CBD oil for patients with severe epilepsy, although it was vetoed by then Governor Butch Otter in 2015. The Idaho Senate passed a bill in 2021 which did include provisions to remove Epidiolex, which contains cannabidiol (CBD), from the list of Schedule IV drugs defined by the Controlled Substances Act with a limited THC content of no more than 0.1%. The production of hemp with up to 0.3% THC was legalized in Idaho shortly after federal legalization with the 2018 Farm Bill.
