Medical Marijuana in Colorado

The Colorado State Constitution was amended on November 7, 2000, when 54% of voters approved Amendment 20, allowing for the use of medical marijuana for approved patients. Medical marijuana patients in Colorado are allowed to possess up to 2 ounces and can grow no more than six pot plants, of which only three can be mature flowering plants at one time. Colorado’s medical cannabis program was amended in 2022 with HB 1317 which among other things, afforded provisions to ensure that patients under 21 truly had qualifying conditions.

Recreational Marijuana in Colorado

The Centennial State was a trailblazer in legalizing cannabis for recreational use, tied as the first state to do so with Washington in the year 2012. Adults 21 years of age and older can legally possess up to 1 ounce of marijuana and are allowed to gift up to 1 ounce to other adult citizens 21 years of age or older. Adults are also allowed to cultivate up to six plants, with no more than three being mature flowering plants in a locked, private space, and can legally possess all marijuana from the plants that grow.

Cannabis Laws in Colorado

It is legal to use, grow, and possess marijuana in Colorado, although there are rules to follow. Cannabis can only be legally purchased from a licensed dispensary which shouldn’t be a problem with more than 500 located across the state. It is illegal to openly possess or consume cannabis on any public property, which includes parks, trails, bicycle paths, shopping centers, parking lots, streets, sidewalks, and other public areas. Cannabis laws in Colorado have come a long way, although there are other states that have surpassed them in areas such as California, New York, and New Jersey which provide employment protections for consumers. In Colorado, both medical cannabis patients and adult-use consumers can still be fired for using marijuana off-hours or for testing positive even days or weeks after consumption.

This is important to note as more than 1/3 of all Colorado land is owned by the federal government, dedicated to national forests and national grasslands. Since cannabis is still illegal on a federal level, possessing or consuming marijuana on any federal land is against the law.
