- Possess up to two pounds of cannabis at their home
- Grow up to 8 plants with only 4 allowed to be flowering at one time. All plants must be in a locked, enclosed space and not visible to the public
- Gift to other adults 21 and over any allowable amount of cannabis or concentrates
- Use cannabis on private property or your private residence as long as the property owner allows it
- Smoking and vaping are not allowed in multi-family housing units like apartments.
Automatic expungement of low-level cannabis offenses is included in the new law along with the creation of the Cannabis Expungement Board to review specific cannabis charges and determine If they should be vacated or resentenced to a lesser offense.
Sales are expected to begin legally sometime in early 2025. Various types of licenses are available, including cultivators, retailers, delivery services, micro-businesses, mezzo businesses, and transporters. The number of licenses issued will be determined by the state’s cannabis regulators, with a percentage of points applying to those with social equity status.
Retail sales will be taxed at 10%, with an additional 6.5% sales and local taxes. Medical cannabis in Minnesota is and will continue to be tax-exempt.
Medical Marijuana in Minnesota
Medical marijuana was signed into law in 2014 with a short list of conditions, and patients were only allowed to ingest cannabis through a vaporized delivery method, pills, or liquid form without the option to purchase or use dried flower, making it extremely restrictive. The program has slowly expanded with additional medical conditions being added and as of May 2021, has expanded the available delivery methods to include smoking raw cannabis flower, which is much more affordable for many patients.
The number of medical cannabis businesses, however, was not expanded with this legislation and the entire state is currently served by only two manufacturers, each with only four dispensary locations.
