North Dakota is a state where 90% of all land area is made up of ranches and farms and leads the country in the production of honey, spring wheat, durum wheat, peas, beans, canola, and flaxseed. You can get cannabis seeds in North Dakota even though you cannot yet grow marijuana, although recreational marijuana with the ability to grow pot in North Dakota is on the ballot for 2022.

Dakota comes from the Sioux word for “friend” or “ally,” and North Dakota must be friendly as the state was voted the happiest state in the U.S. for several years. North Dakota voters will be even happier after the 2022 general election when voters will see a ballot initiative that would legalize marijuana for adults 21 and older. The provisions would allow adults to purchase and possess up to 1 ounce of marijuana and to grow up to three plants for personal use. The provisions are similar to a bill passed by North Dakota’s house in 2021, which was rejected by the Senate.

Cannabis Laws in North Dakota

North Dakota is also known as “The Peace Garden State” as it contains part of the International Peace Garden that borders Manitoba, Canada, where cannabis is legal and regulated throughout the country. Currently, medical use of cannabis in North Dakota is legal, although recreational use is not until we see the results of the 2022 election. Possession of less than ½ ounce of pot is decriminalized in the state since 2019 with no jail time for penalties, although a fine of up to $1,000 could apply.

In 2018, a measure to legalize recreational marijuana in North Dakota was voted on along with Michigan, although it was rejected at the time with only 41% support. Attempts to put legalization initiatives back on the ballot were prevented in 2020, mainly due to the global pandemic. The North Dakota House of Representatives attempted to pass a bill in 2021 for adult use legalized reform, although this House Bill 1420 was defeated in the Senate.

New Approach ND is a coalition of North Dakotans who believe it is time for a new approach and that the current status quo on marijuana is not working. New Approach gathered more than double the amount of signatures needed to clear the way for the ballot initiative in the 2022 general election.
